These terms apply when you use unclaimit.com. If you authorize us to pursue a specific claim, you will sign a separate written authorization for that claim; where that document and these terms disagree, the signed authorization controls.
1. What we do
Unclaimit LLC searches public records for unclaimed property and, if you authorize it, prepares and files a claim to recover that property on your behalf and follows up with the agency holding it.
2. What we are not
- We’re a private company, not a government agency, and are not affiliated with or endorsed by the State of California, the State Controller’s Office, or any county.
- We are not a law firm. Nothing here or in our communications is legal, tax, or financial advice, and no attorney-client relationship is created by using this service.
- You are never required to use us. You may claim property yourself, at no cost, through claimit.ca.gov or the relevant county tax collector.
3. Searching creates no obligation
Running a search is free and commits you to nothing. A search result means a public record exists bearing a name similar to yours. It is not a determination that the property is yours, and it is not a promise that any amount will be recovered.
4. Fees
If we recover funds for you under a signed authorization, our fee is the rate disclosed in that authorization. For state unclaimed property, California Code of Civil Procedure section 1582 limits compensation an investigator may charge. Fees for surplus and excess proceeds recoveries vary by state, county, and account type, and never exceed the maximum allowed by law in the applicable jurisdiction. The fee is deducted from the recovered funds.
You owe nothing upfront and nothing if no funds are recovered — including where a claim is denied, abandoned, or withdrawn. There is no retainer, no hourly charge, and no charge for searching. The exact gross amount, fee, and net payable to you are shown in the agreement before you sign. You may claim property yourself at no cost through the responsible government agency.
5. Your responsibilities
You agree that the information you give us is accurate, that you are the rightful owner or the legal heir or representative of the owner, and that you are entitled to claim the property. You agree to provide documentation reasonably needed to prove that. Submitting a claim you know you are not entitled to may be a crime.
6. Cancelling
You may withdraw your authorization at any time before a claim is filed, at no cost, by emailing help@unclaimit.com. Cancellation rights after filing are set out in the signed authorization. We may also decline or discontinue work on a claim — for example where ownership cannot be established or the claim appears fraudulent — and you will owe nothing if we do.
7. No guarantee of outcome
We cannot guarantee that any claim will succeed, that the amount shown in a public record will be paid in full, or how long an agency will take. Timelines are estimates. Agencies may deny claims, request additional evidence, or pay a different amount than a record indicates.
8. Communications
We contact you only through the methods you consented to, and you can change or withdraw that consent at any time by replying to any message or emailing us. Some messages are transactional — such as your signing link or a status update on an active claim — and are sent regardless of marketing preferences because they are part of the service you asked for.
9. Acceptable use
Do not use this site to search for people other than yourself or someone you legitimately represent, to scrape or bulk-extract data, to probe or interfere with the service, or to submit false information. We rate-limit searches and may block access we believe is abusive.
10. Limitation of liability
To the fullest extent permitted by law, Unclaimit LLC is not liable for indirect, incidental, or consequential damages, and our total liability arising out of the service is limited to the fees you actually paid us in connection with the claim at issue. Nothing here limits liability that cannot lawfully be limited.
11. Governing law
These terms are governed by the laws of the State of California, without regard to conflict of laws principles.
12. Changes
We may update these terms. The version in effect when you signed an authorization continues to apply to that claim. Material changes will be reflected in the date above.
